Didem Yeşilova, İstanbul - Eighth hearing of Can Dündar, Erdem Gül and Enis Berberoğlu who are accused of “aiding and abetting a terrorist organization” was held at İstanbul 14. High Criminal Court. The hearing was not held public due to the confidentiality order made by the court. Next hearing will be held on 6 February.
Defendant Berberoğlu and Gül were present in the hearing along with their lawyers whereas Can Dündar who resides abroad was absent. Dündar's wife Dilek Dündar was in the courtroom to observe the hearing. Republican People's Party (CHP) MPs Sezgin Tanrıkulu and former CHP MP Barış Yarkadaş waited in the courthouse corridor until the hearing was over, to show support.
Berberoğlu is banned to leave the country
İstanbul Chief Public Prosecutor's Office had requested the court to order a ban over Berberoğlu on leaving the country. Court noted that it has accepted the request of the prosecution's office and banned Berberoğlu from leaving the country on 27 September 2018.
Berberoğlu responded, “This judicial control order is unnecessary because I have not been abroad for 4 years. I am a known politician, I will be attending the following hearings in person.”
Defense lawyers requested to lift the confidentiality order over the case file and hold the hearings public, however, their request was rejected due to “national security risks”.
Berberoğlu's lawyers requested to stop the proceeding
CHP MP Berberoğlu's lawyers had requested to stop the proceeding because Berberoğlu has legislative immunity as a member of parliament. The prosecution asked the court to reject the request of the defense lawyers. The court noted that it will review Berberoğlu's request after the defense lawyers complete their documents, and adjourned the hearing until 6 February.
